DPP accepts judges position

THE Judicial Review of an order by Senior Magistrate Judith Pusey that
Director of Public Prosecutions (DPP) Paula Llewellyn write a witness
statement disclosing the contents of a meeting with accused-turned star
witness in the Cuban lightbulb trial, Rodney Chin, came to an end this
morning
This was after attorney Jacqueline Samuels-Brown informed the Judicial
Review Court, following consultations with her client, Pusey, that what
the magistrate had done was to extend an invitation to Llewellyn on
April 16, instead of making an order.
This position was accepted by lawyers representing Cuban lightbulb
accused Kern Spencer and Coleen Wright, as well as the court. But
Diahann Gordon-Harrison, representing the DPP, took an opposing stand.
For about 20 minutes, the court tried getting Gordon-Harris to
understand that and order was not made. She eventually accepted Pusey's
position, and withdrew the action for Judicial Review.
As a result, Spencer and Wright's trial will be mentioned in the
Corporate Area Resident Magistrate's Court on September 17 for a date to
be set for the continuation of the trial.
Pusey's ruling arose out of an application from attorneys representing
Spencer and Wright, after Chin had said during cross examination that
during his meeting in 2008, that the DPP may have been taking notes.
Spencer and Wright are on trial in the magistrate's court in relation to
the handling of the distribution of four million energy-saving bulbs, a
gift from the Cuban Government, that ended up costing Jamaican taxpayers
millions of dollars.
